These Website Terms and Conditions (“Terms”) govern your access to and use of the website operated by Debbie Cox, ABN:37170611490, a sole trader based in Victoria, Australia. These Terms include the purchase of books and other products offered through the website. By accessing or using this website, creating an order or purchasing a product through the website, you agree to these Terms. ​These Terms should be read together with our Privacy Policy and any shipping, returns or other policies published on this website.

1. Australian Consumer Law 

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy available to you under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded or modified. Where any provision of these Terms is inconsistent with a right or remedy that cannot lawfully be excluded, that statutory right or remedy will prevail.

2. Website Use 

You may use this website for lawful personal and commercial purposes associated with viewing information about the author, literary works and products, contacting the business and purchasing products offered through the website.

You must not use the website: 

(a) for any unlawful, fraudulent or malicious purpose; 

(b) in a manner that may damage, disable, interfere with or compromise the website or its security; 

(c) to attempt to obtain unauthorised access to the website, server, databases or associated systems; 

(d) to introduce viruses, malicious code or other harmful material; 

(e) to collect information about other users without authority; or 

(f) to reproduce or commercially exploit website content except as expressly permitted by these Terms or by law. 

We reserve the right to restrict or terminate access to the website where we reasonably believe that a user has breached these Terms or applicable law.

 

3. Products 

The website may offer books, including poetry books, children’s books and other literary or related products. 

We take reasonable care to ensure that product descriptions, images, prices and other information displayed on the website are accurate. Colours, dimensions and appearance may vary slightly from how products appear on a particular screen or device. 

Product availability may change without notice. We may withdraw or discontinue a product where it is no longer available, subject to fulfilling existing accepted orders or providing an appropriate remedy where required by law.

4. Orders 

Placing an order through the website constitutes an offer to purchase the selected product or products in accordance with these Terms. 

An automated order acknowledgement does not necessarily constitute acceptance of an order. An order is accepted when we confirm acceptance or commence processing or fulfilment of the order.

We may decline or cancel an order before acceptance where reasonably necessary, including where: 

(a) a product is unavailable; 

(b) there has been an obvious pricing or product-description error; 

(c) payment cannot be authorised or processed; 

(d) delivery cannot reasonably be made to the address supplied; 

(e) we reasonably suspect fraudulent activity; or 

(f) fulfilling the order would breach applicable law. 

If payment has already been received for an order that we cannot fulfil, the amount paid for the unavailable goods will be refunded using the original payment method where reasonably practicable.

5. Prices and Payment 

All prices are displayed in Australian dollars (AUD) unless otherwise stated. Prices are subject to change without notice. Any price change will not affect an order that has already been accepted. Any applicable delivery or shipping charges will be displayed or otherwise communicated before the customer completes the purchase. GST will be dealt with in accordance with applicable Australian taxation law. Where the business is not registered for GST, GST will not be separately charged. Payment must be made using one of the payment methods made available through the website. Customers are responsible for ensuring that the payment and billing information they provide is accurate and that they are authorised to use the selected payment method.

6. Shipping and Delivery 

Orders will be delivered to the delivery address supplied by the customer during checkout. Customers are responsible for ensuring that delivery information is complete and accurate. Any delivery timeframes stated on the website are estimates unless expressly stated otherwise. Delivery times may be affected by circumstances outside our reasonable control, including postal or courier delays, severe weather, public holidays and other disruptions. We will take reasonable steps to dispatch orders within the timeframes communicated to customers. Where an order cannot be supplied within an agreed timeframe, or within a reasonable time where no timeframe has been agreed, the customer may have rights and remedies under the Australian Consumer Law. Shipping charges, available delivery locations and any applicable international shipping arrangements will be displayed on the website or during checkout.

7. International Orders 

Where international delivery is offered, customers are responsible for providing accurate delivery information and for complying with the laws and import requirements applicable in the destination country. Unless expressly stated otherwise, international customers may be responsible for customs duties, import taxes, levies or other charges imposed by authorities in the destination country. International delivery times may vary due to customs processing and circumstances outside our reasonable control. Nothing in this section excludes any rights available to a customer under applicable consumer law.

8. Returns, Refunds and Consumer Guarantees 

Products sold through this website are subject to the consumer guarantees contained in the Australian Consumer Law where those guarantees apply. Products must, among other applicable guarantees, be of acceptable quality, correspond with their description and be fit for any disclosed purpose where the relevant requirements of the Australian Consumer Law are satisfied. If a product fails to comply with an applicable consumer guarantee, you may be entitled to a remedy such as a replacement, refund or other remedy depending upon the circumstances and whether the failure is major or minor. We do not exclude or restrict these statutory rights. Unless otherwise stated in a separate returns policy, we are not required to provide a refund or exchange merely because a customer changes their mind, orders the incorrect product or no longer wants the product. However, we may choose to provide additional change-of-mind rights at our discretion.

9. Signed, Personalised or Special-Order Books 

From time to time, we may offer signed, dedicated, personalised or otherwise specially prepared books. 

Because personalised products are prepared specifically for an individual customer, change-of-mind returns may not be available for those products. This does not affect any rights or remedies available under the Australian Consumer Law where a personalised product is faulty, damaged, incorrectly supplied or otherwise fails to comply with an applicable consumer guarantee. Customers are responsible for checking names, wording and other personalisation information carefully before submitting an order.

10. Intellectual Property 

Unless otherwise indicated, all intellectual property rights in the website and its content are owned by, or licensed to, Debbie Cox. 

This includes, without limitation: 

(a) poems and literary works; 

(b) stories and written extracts; 

(c) book titles and associated original content to the extent protected by law; 

(d) illustrations and artwork where rights are owned or licensed by us; 

(e) photographs and voice recordings;  

(f) website text and written material; 

(g) graphics and design elements; 

(h) logos and branding; and 

(i) downloadable or digital material. 

Copyright material is protected under the Copyright Act 1968 (Cth) and applicable international copyright laws and treaties. 

You may view the website and make copies reasonably required for ordinary personal use. 

Except as permitted by law or with prior written permission from the relevant rights holder, you must not reproduce, republish, distribute, adapt, modify, communicate, upload, transmit, sell or commercially exploit website content or literary material. 

Purchasing a book or other product does not transfer copyright or other intellectual property rights in the underlying literary, artistic or other protected work.

11. Use of Poems, Stories and Literary Extracts 

Poems, stories, excerpts and other literary material displayed on the website remain protected by copyright. 

Website visitors must not reproduce or publish substantial parts of this material on websites, social media, publications, merchandise or other platforms without permission, except where permitted under Australian copyright law. Requests for permission to reproduce, publish, perform, adapt or otherwise use literary material should be directed to 1debbiecox@gmail.com.

12. Illustrations and Third-Party Creative Works 

Some books or website materials may contain illustrations, photographs, designs or other creative works created by third parties. 

Copyright in those materials may remain with the illustrator, photographer, designer or other rights holder. Nothing contained on this website grants a licence to reproduce third-party copyright material unless expressly stated.

13. Reviews, Comments and User-Submitted Content 

Where the website permits customers or visitors to submit reviews, comments, testimonials or other content, users must ensure that their submissions are lawful, truthful and do not infringe the rights of another person. Content must not be defamatory, threatening, discriminatory, obscene, fraudulent or infringe copyright, privacy or other legal rights. We may moderate or remove content where reasonably necessary, including content that breaches these Terms or applicable law. By voluntarily submitting content for publication, you grant us permission to display and reproduce that content for purposes associated with operating and promoting the business, subject to applicable privacy and consumer laws.

To the maximum extent permitted by law, we exclude liability for loss or damage arising from use of the website where that liability may lawfully be excluded. Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy under the Australian Consumer Law or other applicable legislation that cannot lawfully be excluded, restricted or modified. Where liability cannot lawfully be excluded, our liability will be determined in accordance with the applicable law.

Personal information collected through the website will be handled in accordance with our Privacy Policy and applicable privacy laws.

By contacting us electronically or placing an order through the website, you consent to receiving communications necessary to administer your enquiry, transaction or order electronically. Marketing communications will be managed in accordance with applicable Australian law, including the Spam Act 2003 (Cth) where applicable. Customers may unsubscribe from electronic marketing communications using the unsubscribe facility provided or by contacting us. Transactional communications relating to an order, payment, delivery, customer-service enquiry or other existing transaction may still be sent where appropriate.

These Terms are governed by the laws applicable in Victoria, Australia, together with applicable Commonwealth laws of Australia. 

Subject to any rights a consumer may have to bring proceedings elsewhere under applicable law, the parties submit to the jurisdiction of the courts and tribunals of Victoria and any courts hearing appeals from those courts.
